Abstract

Relevance of cultural factors as a justification for crimes against family members.

Normative references

Art. 572, art. 600, art. 671 Italian criminal code

Ruling

The crime of reduction or maintenance in slavery or servitude does not include the conduct put in place by those who practice begging for a few hours of the day with the help of the minor child, and this due to the absence of a condition of complete enslavement and exclusive use of the minor for the purpose of economic exploitation. Otherwise, this conduct, if it is continuous and causes moral and material suffering to the minor, integrates the less serious crime of mistreatment in the family and, if it results in an isolated episode of begging, the contravention of the use of minors in begging.
