Khasanov and Rakhmanov v. Russia, Nos. 28492/15 and 49975/15, ECtHR (Grand Chamber), 29 April 2022

Abstract

Extradition on ethnic grounds. Prohibition of torture. Prohibition of discrimination. No violation found by the ECtHR.

Normative references

Art. 3 ECHR

Ruling

1. The case concerned the applicants’ allegation that they risked ill-treatment if extradited to Kyrgyzstan because they belonged to the Uzbek ethnic minority, persecuted by the authorities since inter-ethnic clashes in 2010.

2. In extradition cases, states are obliged not only to cooperate in international criminal issues but also to comply with the absolute nature of the prohibition of torture and of inhuman or degrading treatment enshrined in Article 3 ECHR.

3. The Court found no violation of Article 3 ECHR, because recent reports do not identify any specific risk with regard to ill treatment.
