Ruling

Article 3 and Article 23 of Directive 2011/95 / EU of the European Parliament and of the Council of 13 December 2011 must be interpreted as meaning that they do not prevent a Member State from granting refugee status to the minor child of a citizen of a Third State to which that status has been recognized pursuant to the rules established by the Directive, even if the child was born in the territory of that Member State and have, through the other parent, the citizenship of another third country in which he would not be exposed to the risk of persecution.
