Abstract

Ruling

1. Compulsory vaccination, as an involuntary medical intervention, represents an interference with the right to respect for private life within the meaning of Article 8 ECHR (para 33). 

2. The interference with the applicant’s physical integrity could be said to be justified by the public health considerations and the necessity to control the spreading of infectious diseases (para 36).  

3. Checking suitability for vaccination by medical staff prior to carrying out the vaccination suggests that necessary precautions have been taken to ensure the balance of interests between the applicant’s personal integrity and the public interest of protecting health of the population (par 36).
