Ruling

The Court finds that there is a violation of art. 10 of the Convention (right to freedom of expression) in the conviction of the chief heads of a magazine, responsible for publishing an article containing the declarations of the leader of an armed illegal organization. In the present case, there is a violation because the declarations are not deemed to incite violence but rather report the unsatisfaction with the steps taken by the Turkish government to resolve the Kurdish question.
