Ruling

The right to freedom of expression can be legitimately restricted only in exceptional circumstances, as in the case of hate speech or incitement to violence and armed resistance.
(Case concerning the publication of an article, which described a series of conflicts occurring in Turkey between the Turkish army and the PKK (Kurdistan Workers’ Party). The applicants, the director and the owner of the journal, had been convicted of violating Turkish anti-terrorism law and the newspaper was temporarily closed. The Court found a violation of Article 10 ECHR).
