United Kingdom Supreme Court, [2013] UKSC 62, 9 October 2013 (Al-Jedda)

Abstract

Revocation of British citizenship on national security grounds. Involvement in the activity of terrorist groups. Risk of statelessness.

Normative references

British Nationality Act 1981 (UK)

Ruling

The revocation of British citizenship of a naturalized person who lost his/her first citizenship (in the case at issue, the Iraqi nationality) violates the prohibition of statelessness. In fact, the probability that this person will reacquire his/her previous citizenship in a quick and simple way is not enough to prevent the risk of statelessness.
