Ruling

Art. 48 of the Treaty crystallizes a prohibition of discrimination on the basis of citizenship, which prevents an employer from obliging candidates in a competition to prove their language skills only with a diploma that is issued in a province of a Member State. Therefore, while it remains legitimate to require candidates for a job to possess a linguistic diploma, the impossibility of providing proof with equivalent qualifications must be considered a case contrary to the letter of the legislation.
