Abstract

Proscription of an association that carried out "terrorist" activities. Violation of freedom to assembly and freedom of association. 

Ruling

1. Some activities promoted and carried out by Palestine Action do in fact fall within the notion of “terrorism” and “terrorist activity” as defined by the Terrorism Act 2000, insofar as the organization advances its political agenda through unlawful conduct and by inciting such conduct.

2. In order to justify the proscription of the association, the resulting restriction of the conventional rights it entails, and the criminal consequences that follow, the overall scope and continuity of the group’s activities must reach a “high threshold.”
